Outstanding resource for parents & teachers/coaches By Pat Welby Dan Lier's "Is Your Child Wired for Success" is an excellent resource for all parents, teachers and coaches. I have been a teacher/coach for over twenty years and recently became a parent for the first time and found this book to be outstanding! I plan on utilizing this book not only with my own child to help develop a plan for success but with my students and athletes that I work with on a daily basis. A must read for parents and teachers/coaches.

THIS CASEBOOK contains a selection of 220 decisions of the U. S. Court of Appeals for the Federal Circuit that analyze and discuss issues surrounding patent claim construction. The selection of decisions spans from 2004 to the date of publication. In construing claims, th[e] court relies primarily on the claim language, the specification, and the prosecution history. Phillips v. AWH Corp., 415 F.3d 1303, 1314-17 (Fed.Cir. 2005) (en banc). After considering this intrinsic evidence, a court may also seek guidance from extrinsic evidence such as expert testimony, dictionaries, and treatises. Id. at 1317-18. HW Technology, LC v. Overstock. com, Inc., 758 F. 3d 1329 (Fed. Cir. 2014). Ultimately, "[t]he construction that stays true to the claim language and most naturally aligns with the patent's description of the invention will be, in the end, the correct construction." Renishaw PLC v. Marposs Societa' per Azioni, 158 F.3d 1243, 1250 (Fed.Cir.1998). Takeda Pharmaceutical Co. v. Zydus Pharmaceuticals, 743 F. 3d 1359 (Fed. Cir. 2014). Although courts are permitted to consider extrinsic evidence like expert testimony, dictionaries, and treatises, such evidence is generally of less significance than the intrinsic record. Phillips, 415 F.3d at 1317 (citing C.R. Bard Inc. v. U.S. Surgical Corp., 388 F.3d 858, 862 (Fed.Cir.2004)). VirnetX, Inc. v. Cisco Systems, Inc., 767 F. 3d 1308 (Fed. Cir. 2014). Claim terms are generally given their ordinary and customary meaning as understood by a person of ordinary skill in the art at the time of the invention. Phillips v. AWH Corp., 415 F.3d 1303, 1312-13 (Fed. Cir. 2005) (en banc). Such a skilled artisan reads claim language in the context of the claims, the specification, and the prosecution history, using them to resolve any uncertainties. Though the claim term may appear plain on its face, we may depart from that plain meaning "1) when a patentee sets out a definition and acts as his own lexicographer, or 2) when the patentee disavows the full scope of the claim term either in the specification or during prosecution." Thorner v. Sony Computer Entm't Am. LLC, 669 F.3d 1362, 1365 (Fed. Cir. 2012) (citation omitted). Info-hold, Inc. v. Applied Media Tech. Corp., (Fed. Cir. 2015) Claim construction is a question of law [ ] review[ed] without deference. HW Technology, LC v. Overstock. com, Inc., ibid. While the ultimate construction of a claim term is a legal question reviewed de novo, underlying factual determinations made by the district court are reviewed for clear error. Teva Pharm. USA, Inc. v. Sandoz, Inc., No. 13-854, 2015 WL 232131, at *11 (U.S. Jan. 20, 2015). Specifically, "when the district court reviews only evidence intrinsic to the patent (the patent claims and specifications, along with the patent's prosecution history), the judge's determination will amount solely to a determination of law, and the Court of Appeals will review that construction de novo." Id. at *10. However, when the district court looks beyond the intrinsic evidence and consults extrinsic evidence, for example to understand the relevant science, these subsidiary fact findings are reviewed for clear error. Id. Enzo Biochem Inc. v. Applera Corp., (Fed. Cir. 2015). . . .

The recipes are great, but it doesn't take itself too seriously (no Martha Stewart type recipes with 86 ingredients that require 16 hours to finish and leave you with a kitchen full of dirty dishes). This is a cookbook with recipes you'll actually cook!Whether you want light fare for the summer months or warm and satisfying comfort food, there's something in here for everyone. I've only had the book a week and have tried two of the recipes (Caprikorn Farms Chevre & Vegetable Gnocci, page 93, and Grandpa O's Blue Cheese Dip, page 20), both of which turned out wonderfully. I've enjoyed reading through the recipes (cute illustrations!) and will be trying a really awesome-looking Mac-'n-Cheese recipe this weekend. I also have big plans for a gratin recipe from the book that I'll be serving at Thanksgiving!It's a well-written and useful cookbook. I do like that the print is a bit larger than some cookbooks, which is helpful when I'm running around the kitchen. My only complaint is that it would be better with a binding that would lay flat, rather than a spine that wants to close the book all the time while I'm cooking!Terrific book, and you can tell the recipes are compiled with love of fresh ingredients (and cheese!)

Find out what God wants for your life, then follow it and be content."That's good advice as far as it goes, and I'm sure the author meant to be encouraging. However, she comes across as scolding and even a little self-righteous. She sounds more like a coach giving an overly long pep talk to a high school football team that hasn't been trying very hard.There isn't much practical how-to. The book is more about what NOT to do. What should we DO? Get God's revelation! Well, how? How do you hear Him? How do you distinguish His voice from other voices?I also think she's oversimplifying things. Not all of our desires are fleshly and wrong. Not all dreams are unfulfilled because they were never God's will in the first place. A more complete and balanced view is needed.

I reviewed his first book, Point Made: How to Write Like the Nation’s Top Advocates I still think it’s probably the best legal writing book out there. If you’re looking to improve your writing, it’s worth owning – regardless whether you’re a lawyer or not.Now, Guberman has a new book out, Point Taken – How To Write Like The World’s Best Judges. Just as Point Made was an instruction manual on writing briefs for lawyers, Point Taken is an instruction manual on writing opinions for judges. While I’m no judge, and unlikely to ever be one, I still found the book to be informative and helpful, just as with Guberman’s previous work.Point Taken follows a similar format to Point Made – as opposed to merely telling the reader how to write well – it shows them with numerous examples taken from some of the most well written opinions in history and today. Then, Guberman breaks down the examples and offers tactical advice for applying the techniques to one’s own writing.The first half of the book is devoted to technicalities of crafting the opening of an opinion, the facts, and the legal analysis. The second half of the book is devoted to “style.” Parallelism, types of transitions, rhetorical devices, analogies, and more are all covered.Guberman then goes on to break down various techniques used to craft a memorable facts section of an opinion, using examples from the opinions listed. Just as with Point Made, the reader is exposed to many opinions they would have likely never have read. The quality of writing on display is excellent and varied. The lessons given can help any writer – whether judge, lawyers, or layperson.Improving your writing is of paramount importance. Writing is thinking. The better your writing, the more clear your thoughts. If you want to communicate effectively, you have to work at it. Beyond that, your writing needs to be engaging. Guberman quotes Lord Denning, which I will reproduce here:"No matter how sound your reasoning, if it is presented in a dull and turgid setting, your hearers – or your readers – will turn aside. I don't even know where I saw this book online some where a few months back before it even came out & I wanted it to read even though I haven't been in a situation like this (thank god). It's crazy & sad the book it's self. However most importantly amazing that she mad it out of that lifestyle. She definitely was/is a strong woman. I hope others in her same situation make it out like she did, even if it's a struggle sometimes.

The Crazy Stories By stephen johnson Peggy Mercer is a talented author; who draws you into her books and captures your attention with her character Bogg Rivers, leaving you to ponder where Bogg's mom draws her strength to do all that she has to do beyond caring for his needs. Naked Man Beach Trip- is a beautifully written story that leaves you wanting to know what is going to happen with the turn of the page and then in the next story to come. Also, these stories cause you to think about the many families who struggle daily with caring for those with various mental health issues. I have enjoyed reading all of this author's books available here at Amazon! As a former special needs teacher, I would have benefitted by having more books like this available during my 34 year career. I hope other teachers, administrators, counselors and mental health professionals will discover these e-books; read and understand that there is so much we all can do by educating ourselves and others about the importance of providing quality care and supporting those similar to Bogg Rivers and their families. With great appreciation to this author for caring enough to write about a topic that often is neglected and misunderstood by educators and probably many others, too! 2 of 2 people found the following review helpful. This author sees into the mind and soul of the mentally ill. By DKF It is amazing to look into the mind of a mentally ill person like Bogg Rivers. Most people just see them as crazy and try to avoid them. Peggy Mercer sees into their soul. Living in a fantasy, Bogg thinks he is an FBI agent and has a job to do. But returns home when he can't remember his purpose. We don't understand how the brain of the mentally ill works, but Peggy does understand. She sees into not only the mind, but the soul of this mentally ill young man. And she is blessed with the ability to show this to her readers.

4 of 4 people found the following review helpful. Very informative By Miranda Thomason The cover got my interest at first. The beginning of the book was a little more medical than I would have liked. I skimmed over it rather quickly. That is just personal interest. I wanted to get to the stories. This book is well researched and it really struck me the work the author must have put into this book. Mummies, grave robbers, murders for profit for bodies, and vampires were things I had heard before and got a little more detail on. St. Nick was new information. The story of Charles Bryne, the Irish Giant was heart breaking to me. I am currently watching American Horror Story Freak Show, there was a section that was timely for me in that regard. I was glad to see Dorothy Parker's story in the book. The book is full of stories I had a little detail on and learned more about. Some of the stories were entirely new to me.

Pednaud's website the Human Marvels, and so when I heard he was writing a book I couldn't wait to get my hands on it. From the first page of reading After Life it was hard to put down. You learn about mummification, grave robbers, what happened to Einstein's brain and so much more! Not only is the content revealing, but the writing is engaging. J. Pednaud has a way of taking a unique subject and telling a story that is memorable.

Also, for such a morbid subject, he was able to lighten up these stories with some much needed humor. The book itself was excellent. I love ghastly things and this certainly hit the mark. I learned some things that I've never heard of before and even had a few stomach rolling moments. Great job Mr. Pednaud! Yep, I'd recommend this book and author.

Review This book was well written and a very informative and interesting read. Although I did not agree with with all the authors' views and opinions, he did provide evidence to support them and provided much food for thought. He also injected some personal humor which lightened the reading of what I usually consider somewhat dry material.Overall, it was a good read. It was an easy read and I like the organization (chapters by issue), and then providing the history behind the various issues. I think this would be a must read for those supporting the current Obama Administration...you've provided the talking points and backup to his positions, but this is where we part company. As a non-Obama administration supporter, I wasn't convinced to change my positions on the main issues....Global Warming, Health Care, Gun Control, Energy, and the many other issues that differ between the Obama and non-Obama supporters. I think most of the references or conclusions were based on "opinions" versus "facts". I don't believe doomsday will be here soon for the environment, but current activities to improve clean air should continue. Improving health care with changes and new enhancements should happen along with better gun control, and cleaner energy production. I think many steps have already been taken with these objectives in mind, but need to be accelerated. These are major issues, and I too would like to get agreements by all on final solutions....but I like a more "realistic moderate approach"......In short, these are big issues that will require patience, a lot more thought, long term direction and agreements, and a realistic implementation plan.My only negative regarding your book, was the bashing of previous administrations, which I would have left out..... That's history, not needed, doesn't help, and won't change anything. From the Author About the Author-            I am a graduated from the University of Virginia with a Bachelorof Science degree in physics. I spent most of my career in the design of powergenerating stations. While working I earned masters degrees in mechanical engineering and in business and I am a Professional Engineer in New York State.  In the early 1970s, I served in the Peace Corps in Swaziland, Africa teaching engineering.  I was raised in a family that was very interested in political discussion. As a youth, I used to sit around the kitchen table and listen to "grown ups" discuss the cold war, business, unions and communism. I think it is natural then that I continue to have an interest in politics. I have published one other book,"The Newcomers Guide to Winning Location Elections", and I lives in Vermont with my wife. I have two children and three delightful grandchildren.

I don't believe I can say enough good about it.I was sceptical at first, wondering if I was going to be reading a well thought out book or a another conspiracy nuts jumbled thoughts. I was pleasantly surprised.Not only was the book well written, it was well thought out. It touches on the topics of Gun control, global warming, finances, healthcare, and a bunch of other big debate items.Each chapter is short enough to keep you on track but very detailed. The author writes the chapters like a typical persuasive essay. He uses minimum yet humorous opinions and backs everything up with facts; that are linked and cited at the end of each chapter. I found that to be very thoughtful. I also enjoyed how he added the constitution and amendments into the chapters breaking them down into how they were meant to be taken and how they have been interpreted. He also gives thoughts on both sides of the argument and not just the one he feels is the correct side.As I mentioned above he talks about a lot of the big issues giving multiple examples for each and why America is failing. After he has thoroughly explained why each item is an issue backing it up with research and facts he gives several logical solutions to fixing the issues at hand. He is also not delusional. Some of the issues closely border on not fixable or unlikely to be fixed because America is not ready or willing to fix them and he discusses why this is and the steps needed to move towards the possibility of bettering America because he also realises a quick fix is not and truthfully just can't happen.A highly enjoyable book

There was part where I agree with his opinion and his research and sometimes I dont. Its all understandable because everyone opinion was different. However, there was no part that I strongly disagree and dislike which made it a bonus, at least there wasnt anything that made me frustrated. I also liked how the author wrote the book from the start, its packed with content and the plot kind of flow on a normal pace without any unnecessary details. Im impressed with how intent the author made his research too, to know that much of details, that must take a lot of work. His writing reflects his research, thats for sure. Overall, if you want to know deeply about politic in America, this book is for you as it discussed everything.
